Terms of Service

1. Acceptance

By accessing or using any service provided by YourFirstAI Inc. ("YourFirstAI", "we", "us"), you agree to these Terms. If you do not agree, do not use the services.

2. Definitions

• Services: the Express offer (an AI-powered website with a working AI agent), related tools, and any consulting we provide
• User: the individual or organization that uses the Services
• Content: text, images and code created or submitted by Users
• Credits: pre-paid units of consumption for metered tools

3. Accounts

You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable use

• Lawful business and personal use
• Compliance with applicable laws (privacy, copyright and intellectual property)
• No unlawful, discriminatory, malicious content or content that infringes third-party rights
• No attempts to circumvent usage limits, reverse-engineer, or harm the infrastructure

5. Deposits, credits and billing

• Where a service starts with a refundable deposit, the amount is stated on the order form at checkout. You pay the remaining balance only when the delivery passes an objective acceptance checklist agreed in advance
• Where credits apply, they are valid for 12 months from purchase
• Payments are processed by Stripe
• Consumed credits are non-refundable. Unused credits may be refunded within 7 days of purchase
• All prices are in Canadian dollars (CAD)

6. Intellectual property

• User Content: remains the property of the User. You grant YourFirstAI a non-exclusive license to process it in order to deliver the service.
• Generated outputs: owned by the User (you may use them commercially). YourFirstAI claims no right to use outputs generated for your project.
• Platform: our code, brand, design and methodology are the exclusive property of YourFirstAI Inc.
• AI models: Gemini and similar models belong to their providers. Provider terms apply in addition to these Terms.

7. Limitation of liability

The Services are provided "as is". We do not guarantee uninterrupted availability, the complete absence of errors, or fitness for a particular purpose. YourFirstAI Inc.'s liability is limited to the amount paid by the User in the 12 months preceding the event giving rise to the claim. We are not liable for lost profits or indirect or consequential damages.

For critical use (health, legal, financial), AI outputs are supporting tools — the final decision always rests with the professional or User.

8. Suspension and termination

We may suspend or terminate access in cases of breach of these Terms, fraud, improper chargeback, or conduct that harms other Users. Data may be deleted 30 days after termination (except where legal retention applies).

9. Changes

We reserve the right to update these Terms. Material changes will be communicated 30 days in advance. Continued use after a change constitutes acceptance.

10. Governing law and jurisdiction

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. The courts located in Ontario, Canada have exclusive jurisdiction over any dispute arising from these Terms.
